Before reaching the merits we have to dispose of a question raised by a bill of exceptions, which we find in the record taken *471by defendant. The bill recites that on the trial of the cause, after a jury of twelve had been empannelled, the pleadings read, testimony partially adduced and the trial proceeded with for one day, that on the morning of the second day one of the jurors, who had been sworn in the •case, was reported sick, and unable to attend court, whereupon the preaiding judge ordered that additional jurors be summoned as in…
