MEMORANDUM OPINION AND ORDER
PALLMEYER, United States Magistrate Judge.
Plaintiff Mid America Title Company (“Mid America”) and Defendant James Kirk, an attorney associated with the Attorneys’ Title Guaranty Fund, are both in the business of performing title searches and preparing title insurance commitments for real estate in Illinois. In the spring of 1985, Mid America prepared a title insurance commitment on behalf of a lender for a parcel of real estate in Will County, Illinois.
