This is an action by the assignee of a firm of attorneys and counselors at law to recover damages for the breach of a contract of professional employment. The plaintiff’s assignors were retained by the appellants’ testator to recover an award in condemnation proceedings. The contract stipulated that the compensation to be paid should be contingent upon success and fixed the sum that was to be paid in event of success as a proportion of the amount recovered.
