This matter comes before us pursuant to the disciplinary rules and upon the following recommendation:

“To the Honorable Judges of the Above Entitled Court:
“Be It Known that at the meeting of the Board of Governors of Washington State Bar Association held at Seattle, Washington on the 8th day of June, 1940, all members of the Board being present, the record in the above proceedings was reviewed and it was unanimously resolved (Hugo Metzler not participating) that the Findings of the Trial Committee be approved; that upon said Findings, the Board recommends that Respondent W.
