The testimony is undisputed that the ducks were killed in certain townships in Mississippi’ County, Arkansas, where it was lawful to sell and transport them beyond the limits of the State, under the act of June 1, 1909; and the court found that they were packed in barrels and not plainly and clearly marked, so that the contents could be readily ascertained, and not packed and shipped in accordance with the requirements of the Lacey Act; that they were not delivered at their destination by defendant’s connecting carrier because of being taken from its…
