This is an action growing out of an exchange of 4,480 acres of land in LaPorte and Starke counties, Indiana, owned by appellant, for 61,000 acres of land in Osceola and DeSoto counties, Florida, owned by appellee, consummated in the year 1916.
The second amended complaint, on which the case was tried, was filed on November 11,1925, and in substance is as follows: Appellee is a corporation, duly organized, chartered and existing under the laws of the state of Florida.
