Upon the petition of the relator, a resident and taxpayer of the county of Aitkin, the district court of that county granted him an alternative writ of mandamus requiring the county auditor of Aitkin county to place upon the tax list certain parcels of land described in the petition, to extend against such parcels their just proportion of taxes, and to cause the taxes to be collected, or to show cause why he had not done this.

This is an appeal from the judgment of the district court of the county of Aitkin, adjudging that a peremptory writ of mapdamus issue, directing the appellant, as county auditor, to place three certain parcels of land upon the tax list of the county for the year 1897.
The first tract is the property of the St. Paul & Duluth Railroad Company, the second is owned by the Northern Pacific Railroad Company, and the last belongs to the Great Northern Railway Company.
