COMBS, Justice.

This action was commenced by a group of property owners in the City of Leitch-field to prevent the City from levying an assessment against their property to pay for street improvements.

The plaintiffs, property owners, contend that the City has proceeded without statutory authority in that the program was initiated before the Act on which the City relies became effective; that the work was incomplete and defective when the assessment was made; and that' the property owners were not given notice and opportunity to protest the acceptance of the work.
