— Reversing.

This action was brought against the appellant, Town of Russell, in the Greenup Circuit Court hy the appellee, W. G. Whitt, seeking the cancellation of a lien against certain real estate in that town owned by him, which lien was claimed by the town for the original construction of a street, known as Etna Street, abutting the property, the amount thereof being $163.63.
