This cause was transferred to this court after decision by the district court of appeal of the first district, because of the contention of the appellant that the ease having heretofore been heard on appeal (20 Cal. App. 504, [129 Pac. 597]), the second decision departed from the law of the case as established on the first appeal. On a more extended examination of the record than was possible in eon sidering the petition for rehearing, we are satisfied with the opinion of the district court of appeal written by Justice Bichards, and adopt the same as the opinion of this court.
