DECISION AND ORDER

McAVOY, District Judge.

Plaintiffs commenced this action against the United States, and officers and agents of the Immigration and Naturalization Service (“INS”), alleging violations of the First, Fourth, Fifth, and Ninth Amendments, the Federal Tort Claims Act (“FTCA”), and 42 U.S.C. Sections 1981, 1985(3), and 1986.

Plaintiffs are two adult migrant farm-workers, Hermenegildo and Francesca Gallegos, their five children, Jorge, Maria, Norma, Luis, and Jose (all minors on June 21, 1985) and another migrant farmworker, Jesse Carreon (also a minor on June 21, 1985). Plaintiffs…
