This action is brought to recover certain rents collected and held by defendant Willard. One William J. Morehart, Jr. was the owner of a farm in Blue Earth county. Morehart lived in California and employed Willard as his agent to rent the farm and collect the rent. Some of Morehart’s relatives made claims to the land. After Morehart died Willard continued to rent the farm and collect the rents, and, not knowing who was entitled to the same, held them for the persons entitled thereto.
