The United States brought this action against Applied Pharmacy Consultants, Inc., and Charles Shuster, its principal officer and shareholder, to recover Medicare payments that were claimed to be in excess of the value of medical devices actually furnished by Applied. The theory of the case was that the United States was billed and paid for one sort of device, whereas in fact, another, less valuable, device was furnished.
