Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondents which denied petitioner Barry McCarthy’s application for recalculation of his final average salary.

Petitioner Barry McCarthy (hereinafter petitioner) was employed as a sergeant with almost 30 years of service by the Port Authority Police Department of New York and New Jersey.
