Cross appeals from a judgment of the Supreme Court (Kavanagh, J.), entered March 2, 2004 in Albany County, which partially granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of respondent calculating petitioner’s retirement benefit.

Petitioner, a retired public school administrator, challenges respondent’s calculation of his retirement benefit. Because of the date on which he joined respondent, petitioner was entitled to have his retirement benefit calculated by using two alternate methodologies—one based on a three-year final average salary…
