THIS CAUSE comes before the Court upon the Defendant Emusica Entertainment Group, Inc.’s (“Emusica”) Motion to Dismiss Plaintiffs Amended Complaint and Incorporated Memorandum of Law (D.E. # 15), filed April 18, 2008. This Motion has been fully briefed.
