FACTUAL BACKGROUND

This action arises out of a dispute concerning the copyright in certain makeup designs (the “Makeup Designs” or “Designs”) created for the cast of the Broadway musical Cats (“Cats” or “the musical”). Plaintiff Candace Anne Carell (“plaintiff’) filed this action on July 12, 1999, asserting claims for copyright infringement, false designation of origin, antitrust violations, and an accounting for profits, arising out of defendants’ use and publication of the Makeup Designs.
