STEPHENS, Circuit Judge.

This is an appeal from a judgment of dismissal of a bill of complaint theretofore filed in the district court in which the specific performance of a contract is prayed. The case was brought in the federal court under allegations that diversity of citizenship of parties exists 28 U.S.C.A. § 41(1) (b)], and that the value of amount involved in suit exceeds the jurisdictional minimum of more than $3,000 exclusive of interest and costs [28 U.S.C.A. § 41(1)].
