— This is a garnishee controversy. It comes to this court upon the appeal of the garnishee defendant, First National Bank of Montesano, the original defendant, M. & E. Theatres, joining therein, from a judgment of the superior court for Grays Harbor county awarding money recovery in favor of the Theatre Equipment and against the bank, as garnishee defendant indebted to the M. & E. Theatres.

The controlling facts are not in dispute. For present purposes, they may be summarized as follows :
