OPINION OF THE COURT

FREEDMAN, Circuit Judge.

This is an appeal by plaintiff from a judgment entered against him following the granting of defendant’s motion to dismiss.

Plaintiff, who appears pro se, was given leave to proceed in forma pauperis and filed what he designated as a “declaration.” In response to this the defendant filed a motion for a more definite statement. The district judge granted the motion and ordered the plaintiff to file a more definite statement in compliance with his memorandum opinion, stating that otherwise the complaint would be dismissed.
