The defendant, Ernest Weaver, was convicted of the crime of grand larceny in the district court of Salt Lake county, and was by the court sentenced to a term of imprisonment. From this judgment plaintiff appeals. The grounds relied on by him for reversal of the judgment are: (1) The overruling of defendant's motion for a new trial; (2) insufficiency of the evidence to support the verdict; (3) that the verdict is contrary to law; (4) the refusal of the court to strike certain testimony. The defendant was charged jointly with George Ross, but the two were separately tried.
