HUG, Circuit Judge:

This is an appeal concerning the pretrial exclusion of evidence under Rule 403 of the Federal Rules of Evidence. Laurence John Layton (“Layton”) was charged with conspiracy to murder and aiding and abetting the murder of Congressman Leo Ryan, and also with conspiracy to murder and aiding and abetting the attempted murder of Richard Dwyer, the Deputy Chief of Mission of the United States in the Republic of Guyana.
