This matter is before the court on the United States’ motion for summary judgment. Plaintiffs and third party defendant have responded to the United States’ motion; therefore, this matter is ripe for ruling.

STATEMENT OF THE CASE

These actions were filed separately but consolidated with the consent of the parties. Plaintiffs brought these actions pursuant to the Federal Tort Claims Act, 28 U.S.C. § 2671, et seq. (“FTCA”).
