The Farmer,s’ Loan & Trust Company, trustee, instituted this suit in the circuit court of the United States for the Eastern district of North Carolina in March, 1894, for the purpose of foreclosing the first mortgage, dated June 1, 183(3, executed by the Cape Fear & Yadkin Valley Kailroad Company. The Mercantile Trust Company of Baltimore, the trustee in the second mortgage, known as the “consolidated mortgage,” dated October 1, 1889, was made a party defendant, and subsequently, when it resigned its trust, William A. Lash was substituted as trustee under the mortgage and…
