The above appeals have been consolidated, and consolidated briefs have been filed.

In the case of James C. Batts et al., supra, an action was brought by employees of the Louisville and Nashville Railroad Company, hereinafter referred to as L&N, who claimed to have been ad-adversely affected by a merger of the above-named railroad company with the Nashville, Chattanooga and St. Louis Railway, hereinafter called N.
