ALTIMARI, Circuit Judge:

Petitioner-appellant Peter Grassia appeals from a judgment entered in the United States District Court for the Southern District of New York (Kenneth Conboy, Judge), denying his petition for a writ of habeas corpus. Grassia asserts that his attorney induced his plea of guilty to second degree murder through fraud and misrepresentation, thereby depriving him of his constitutional right to the effective assistance of counsel.
