This is a proceeding, by motion, in the St. Louis circuit court, for execution against Seligman •as a stockholder on a judgment in favor of plaintiff, against the Memphis, Carthage & Northwestern Railroad Company, an execution having issued thereon against said company, on which a return of nulla bona was made. Defendant resisted the motion, on the ground that he was never a stockholder in said company, and this is the only question which it is necessary to consider.
