Defendant, Charles Thomas, was convicted of possession of cocaine with intent to distribute within 1,000 feet of school property, in violation of N.J.S.A. 20:35-7. The issue presented in this appeal is whether the State produced sufficient evidence for a jury to conclude that the school property was “used for school purposes.” A divided panel of the Appellate Division affirmed the conviction, the dissenting member concluding that the State had failed to sustain its burden of proof. 256 N.J.Super. 563, 572-74, 607 A.2d 997 (1992).
