The parties will be designated herein as they appeared in the trial court. Plaintiff’s petition alleges, in substance, that he owns lands in Pottawatomie county, which lands with the improvements are of tlhe value of ¥6,000, and the land is the home of plaintiff and his family; that the improvements consist of. a house, barn, hog wire fences; five acres of growing cherry trees, plums, apples, peaches, berries, grapes, and five acres of alfalfa; that his livestock consisted of horses, cows, hogs, chickens, and turkeys; that the bed of a stream meandered across his lands, and…
