MEMORANDUM OPINION AND ORDER

Jurisdiction exists on the basis of diversity of citizenship of the parties, 28 U.S.C. § 1332. The factual background out of which this litigation arises concerns a truck-train collision in Adams County, Colorado, on about November 20, 1965. The tractor-trailer vehicle involved in the accident was operated by an employee of Ruan Transportation Corporation, an Iowa corporation, the plaintiff herein.
