MEMORANDUM OPINION

STROM, Chief Judge.

This matter is before the Court on defendants M.D. Electronics (hereinafter M.D.) and Joseph Abboud’s motion to dismiss plaintiff’s cause of action for failure to state a claim upon which relief can be granted, Fed.R.Civ.P. 12(b)(6) (Filing No. 11). Defendants also move the Court for an order dismissing plaintiff’s first and second claims for relief for failure to plead fraud with the particularity required by Fed.R.Civ.P. 9(b), or, in the alternative, pursuant to Fed.R.Civ.P. 12(e), requiring more definite and certain allegations pertaining to the…
