This is an action to enjoin permanently an order of the Interstate Commerce Commission (ICC). The plaintiffs, consisting of most, if not all, of the major railroads in the United States, are required by 49 U.S.C. § 6 to publish or cause to be published schedules of rates or tariffs for the transportation of passengers or property in interstate and foreign commerce. Intervening plaintiffs, members of Freight Forwarders Tariff Bureau, Inc., are required by 49 U.S.C. § 1005 to publish or cause to be published schedules of rates or tariffs for their services…
