MEMORANDUM OPINION AND ORDER
SPORKIN, District Judge.
Background
This matter comes before the Court on defendant’s motion for summary judgement and plaintiffs cross motion for partial summary judgment. Plaintiff (JAC) seek collapse loss coverage for five parking garages in the District of Columbia under an insurance contract with the defendant. This Court has jurisdiction under 28 U.S.C. § 1332. There is complete diversity of citizenship between the parties and the amount in controversy is greater than $50,000. 1
