MEMORANDUM OPINION REGARDING APPOINTMENT OF EXAMINER
JAMES E. YACOS, Bankruptcy Judge.
On January 20, 1989 this court issued an Amended Order to Show Cause Re Appointment of Examiner (Court Document No. 1609). The court stated that “if the parties in interest cannot reach a consensual agreement on rate levels, this court will consider ... whether the appointment of a neutral, disinterested person with requisite expertise on rate impact questions should be ordered as conducive to fostering a consensual plan and negotiations_” The court further stated that, should the hearing on exclusivity…
