Currently before the court is a motion to dismiss or in the alternative, motion for summary judgment, filed by the defendants, Michael B. Donley, Secretary of the Air Force; Major General James A. Ryan, in his capacity as an agent of the Secretary of the Air Force; Lieutenant Henry C. Varnadore; Lieutenant Colonel Paul Duvall; Senior Master Sergeant Charles Mitchell; and Master Sergeant Roger McConnell.
