ORDER
CAMPBELL, District Judge.
This ease is now before the court on defendants’ motion for summary judgment and on plaintiffs motion for partial summary judgment. The court held hearings on these matters on February 18, 1997, and on May 13, 1997. Jeffrey D. Eisenberg appeared on behalf of plaintiff, and Donald Hansen and Barbara Ochoa appeared on behalf of defendants.
