MEMORANDUM OPINION
MOON, District Judge.
Defendants 1 filed two separate motions to dismiss pursuant to Fed.R.Civ.P. 12(b)(6), one in the named defendants’ official capacities and one in their personal capacities. Both motions allege that the complaint fails to state a claim upon which relief can be granted. Because plaintiffs have filed with their complaint extensive documentation surrounding their claims, the Court is able to make conclusions concerning the case which normally might be made pursuant to a Rule 56 summary judgment motion.
