OLSZEWSKI, J.:

¶ 1 The Commonwealth appeals the order of the court below granting appellee’s motion to dismiss pursuant to Pa. R.Crim.P. 6013(g). We reverse.

¶ 2 On March 31, 1998, appellee was convicted of attempted theft and criminal mischief in municipal court. He appealed his conviction to the Court of Common Pleas of Philadelphia County and requested a trial de novo. The court fisted the trial date for June 3, 1998.
