BEAN, District Judge.

This is an action commenced in the Northern district of California to recover damages for breach of contract. The plaintiff is a New York corporation, doing business in San Francisco; the defendant is a corporation organized and existing under the laws of Russia, and doing business at Vladivostok.

In August, 1920, the plaintiff sold to the defendant a large quantity of merchandise, to be, and which was, shipped to it at Vladivostok, draft with bill of lading attached. The draft was not paid upon presentation, and it was thereupon agreed between the parties that the…
