Plaintiff in error was defendant below, and defendant in error was plaintiff. Defendant was a live stock commission company doing business in Oklahoma City. Some time prior to the transaction involved in this suit, one Gay was in the Oklahoma City office of the defendant company, and was asked by one ■ Wither-spoon, who was the secretary and treasurer and the local managing officer of said company. why he, Gay, did not go to work, to which Gay answered that he did not have the money.
