March 22, 1880, the plaintiff executed a written assignment to her. attorneys of that portion of the judgment which they were to receive for their services and expenses in the action.

statement of facts. It appears from the record in this case, that on January 11, 1878, Nancy C. Johnson was injured by a fall, which she experienced while attempting to step from one cars °f the Atchison, Topeka & Santa Fg railroad company to the gronndj at Raymond, Kansas. Afterward, and .prior to April 11, 1878, Mrs. Johnson entered into a parol contract with J. H. Smith and C. T.
