Appeal from, Marshall District Gourt. Plaintiffs are attorneys at law, practicing their profession as partners, at Marshalltown, in this State. In March, 1867, John S. and Robert N. Thompson, sons of defendant, aged 12 and 26 years, while crossing in a wagon belonging to defendant, the track of the Chicago & Northwestern Railway Co., were ran over by the locomotive and train, the property destroyed and the children killed.
