DOERNER, Commissioner.
Plaintiff insurer sought a declaratory judgment decreeing that the policy of liability insurance it had issued to Charles M. Kollmeyer, its named insured, did not cover the liability of defendant Lammert who was driving the Buick automobile of the named insured at the time that the accident occurred. The trial court held that Lammert was covered under the policy, and for reasons which will shortly appear entered a judgment against plaintiff and in favor of defendant Harry William Peterson for $5500.00, together with interest, on the latter’s counterclaim.
