MEMORANDUM OPINION

BRUCE D. BLACK, District Judge.

On December 28, 2009, Mr. Michael Lobato, a former employee of the New Mexico Environment Department, Environmental Health Division (the Health Division), filed suit against the Division, his supervisors, and several co-workers. He has alleged discriminatory and retaliatory treatment in violation of Title VII, the First Amendment, the Fourteenth Amendment Equal Protection and Due Process Clauses, and the New Mexico Human Rights Act.
