The appellee recovered a judgment against the appellants in an action of ejectment for the land described in the declaration and nominal damages. At the trial the defendant offered in evidence a mortgage from the plaintiff to J. Rogers Maxwell, and Robert W. de Forrest, trustees, "for the purpose of showing that the plaintiff had not such a title to the property in controversy as to entitle it to sustain the action of ejectment," and the Court, upon objection, refused to admit it.
