This is an original proceeding in mandamus by the City of El Paso against the Honorable M. V. Ward, Judge of the El Paso County Court at Law. and Mr. Esteban Alba. On motion of petitioner leave to file the petition was granted, notice thereof served upon respondents, each of whom have duly appeared and filed answers herein. Sought was to compel respondent Ward to enter judgment on the report of the Commissioners in a condemnation proceeding seeking to condemn the property of respondent Alba.
