Appeal by defendant from a judgment of the Supreme Court, Queens County (Leahy, J.), rendered November 16, 1981, convicting her of assault in the third degree, upon a plea of guilty, and imposing sentence. The appeal brings up for review the denial of defendant’s motion to dismiss the indictment.
Judgment reversed, on the law, defendant’s motion to dismiss the indictment granted, indictment dismissed and matter remitted to the Supreme Court, Queens County, for the purpose of entering an order in its discretion pursuant to CPL 160.50.
