Appeal from an order of the Supreme Court (Mulvey, J.), entered January 9, 2008 in Tompkins County, which denied defendant’s motion for summary judgment dismissing the complaint.

On January 27, 2004, plaintiff, while a passenger in a vehicle driven by his girlfriend, defendant Michelle Keyser, and owned by Keyser’s parents, was seriously injured when they were involved in a single car accident in Tennessee.
