Appeal from a judgment of the County Court of Schenectady County (Tomlinson, J.), rendered January 23, 2004, convicting defendant upon his plea of guilty of the crimes of criminal sale of a controlled substance in the third degree and assault in the second degree.

On April 30, 2003, defendant sold a quantity of cocaine to an undercover police officer. At the time of the sale, defendant and the police officer were located in front of a residence in the City of Schenectady, Schenectady County.
