MEMORANDUM OPINION AND ORDER
QUARLES, District Judge.
On January 11, 2001, the Court of Appeals of Maryland held that William Ray Miller breached his fiduciary duty to Cigna Insurance Company (“Cigna”) by: (1) failing to collect and forward insurance premi- urns to Cigna, though he was contractually-obligated to do so; (2) failing to convey to Cigna his knowledge that the premiums at issue were being diverted from Cigna for the use of Miller’s employer; and (3) obtaining premium financing for an insurance premium of a Cigna insured but using the funds to pay other expenses.
